Hi, i have an interview at an insurance firm which deals with solicitors and barristers Indemnity Insurance. It isn’t cold calling the Insurance company have been hired by these the companies to provide insurance. The role i am applying for is contacting these individuals to get more information where necessary. What kind of questions can i expect? thank you

You can expect the same kinds of questions you would get on just about any job interview. There may be some questions concerning your knowledge of the legal system but they will train you to do your actual job.

You can expect the same kinds of questions you would get on just about any job interview. There may be some questions concerning your knowledge of the legal system but they will train you to do your actual job.

In the performance of duties as an officer of a Home Owner’s Association (HOA), an officer may commit an act which they did not know was illegal. And if the HOA is sued for damages as a result of that officer’s act, a officer’s indemnity policy might be called on to provide legal representation for that officer under the premise that the officer was unaware that what they were doing was illegal.

In the situation where the officer KNOWS that what they are doing is contrary to the directions of the homeowners, AND they commit a crime to defraud others outside the HOA for the benefit of themselves and the homeowners, that would be willful misconduct, whether they recognized their act was illegal or not when they commit the act. Do officer indemnity policies typically insure such willful misconduct of officers? Is the provision of legal representation for HOA officers by the insurance company typically given in an indemnity policy regardless of whether the officer knew what they were doing was wrong or against the homeowners directions’ when they commit the act? Or do insurance companies providing officer indemnity coverage typically have a policy clause whereby WILLFUL acts of misconduct against homeowner directions or the laws of the land resulting in a crime, are not "covered acts."?

In order to solve this issue, you should first file a complaint with your local District Attorney’s Office. Only they can determine if the acts were a violation of law. If so, then they will proceed accordingly.

If the person was acting for their own benefit, and against the wishes of the Association, the Insurance coverage probably will not help. However, if the DA’s office refuses to prosecute, then you could potentially be covered, since no chargeable crime occurred.

On the civil side, you can always file a complaint against the HOA, and see where that leads. You would probably want to sue the wrong-doer as both an individual and as an officer of the corporation, and see where things go from there.

The individual’s homeowners or professional liability coverage (if any) might help where the HOA’s policy does not.
